This website is operated by Maghi Digital. Throughout the site, the terms “we”, “us” and “our” refer to Maghi Digital. Maghi Digital offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

SECTION 5 – PRODUCTS OR SERVICES

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 7 – DISTRIBUTION PARTNER FRAMEWORK

7.1 Use of Distribution Partners

The Artist/Label acknowledges and agrees that Maghi Digital utilizes authorized third-party Distribution Partners to deliver Content to Digital Service Providers (“DSPs”) and to process revenue settlements. This partnership model enables Maghi Digital to provide comprehensive global distribution coverage, access to exclusive platforms, faster delivery times, and efficient payment processing across multiple territories and currencies.

Maghi Digital’s current primary Distribution Partner for content delivery, store integration, and payment processing is 7tunes Music (or such other partners as Maghi Digital may engage from time to time at its sole discretion). Through this strategic partnership, your Content reaches major DSPs including but not limited to Spotify, Apple Music, JioSaavn, Gaana, YouTube Music, Amazon Music, Wynk, Boomplay, Deezer, and 150+ other platforms worldwide.

7.2 Nature of Partnership

The Artist/Label expressly acknowledges, understands, and agrees that:

• Maghi Digital operates as an independent intermediary service provider and is not an agent, employee, partner, joint venturer, or representative of any Distribution Partner
• Distribution Partners operate under their own independent terms, policies, fee structures, and business practices over which Maghi Digital has no control
• The relationship between Maghi Digital and its Distribution Partners is a B2B (business-to-business) arrangement that does not create any direct relationship between the Artist/Label and the Distribution Partner
• Maghi Digital has no control over Distribution Partner’s internal policies, revenue calculations, deductions, payment timelines, or business decisions

SECTION 8 – PROHIBITED COMMUNICATIONS & DIRECT CONTACT POLICY

8.1 Strict Prohibition on Direct Contact

THE ARTIST/LABEL IS STRICTLY AND ABSOLUTELY PROHIBITED FROM DIRECTLY CONTACTING, COMMUNICATING WITH, REACHING OUT TO, OR ATTEMPTING TO ESTABLISH ANY DIRECT RELATIONSHIP WITH MAGHI DIGITAL’S DISTRIBUTION PARTNERS, INCLUDING BUT NOT LIMITED TO 7TUNES MUSIC OR ANY OTHER CURRENT OR FUTURE DISTRIBUTION PARTNER.

SECTION 9 – REVENUE, ROYALTIES & NET REVENUE POLICY

Maghi Digital shall pay the Artist/Label Ninety-Five Percent (95%) of the Net Revenue actually received by Maghi Digital from its Distribution Partners that is attributable to the Artist/Label’s Content. Maghi Digital shall retain Five Percent (5%) as its service fee and operational costs.

9.3 Net Revenue Pass-Through Policy – CRITICAL PROVISION

Maghi Digital’s obligation to pay royalties is based solely on the Net Revenue actually received from Distribution Partners. We are under no obligation to pay any amount based on Gross Revenue or theoretical earnings.

SECTION 10 – INFRINGEMENT, LEGAL ACTIONS, PENALTIES & REVENUE IMPACT

Any legal action, penalty, or settlement resulting from the Artist/Label's content shall directly impact the Artist/Label's royalty payments. Maghi Digital shall have absolutely no obligation to compensate the Artist/Label for such losses.

SECTION 11 – PAYMENT TERMS & WITHDRAWALS

All payments are made strictly on a “Received Basis.” The minimum withdrawal threshold is ₹500 (Five Hundred Indian Rupees). Withdrawal requests are typically processed within 7-15 business days.

SECTION 12 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You agree that we provide access to such tools “as is” and “as available”.

SECTION 13 – THIRD-PARTY LINKS

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy.

SECTION 14 – USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

You agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

SECTION 15 – PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 16 – ERRORS, INACCURACIES AND OMISSIONS

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information at any time without prior notice.

SECTION 17 – PROHIBITED USES

In addition to other prohibitions, you are prohibited from using the site or its content for any unlawful purpose, to infringe upon intellectual property, or to upload malicious code.

SECTION 18 – ARTIFICIAL STREAMING & FRAUD PROHIBITION

Any attempt to artificially increase streaming numbers using bots or deceptive methods is strictly prohibited. Violators will be fully liable for any penalties or losses incurred.

SECTION 19 – COPYRIGHT & INTELLECTUAL PROPERTY

All rights, titles, and interests in all materials which are capable of protection by copyright are the property of Maghi Digital or its contributors. Any violation will result in immediate termination.

SECTION 20 – YOUTUBE CONTENT ID & MONETIZATION

Maghi Digital holds all rights to remove content and forfeit revenue if Content ID misuse is identified (e.g., attaching your content to popular movies or unrelated content).

SECTION 21 – DOCUMENTATION & VERIFICATION

You must provide requested documentation for your songs promptly. Failure to do so may result in account suspension or termination.

SECTION 22 – USER CONDUCT & MISBEHAVIOR

Any form of misbehavior towards our staff is strictly prohibited and may result in the termination of your services without refund.

SECTION 23 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

The service is provided 'AS IS' and 'AS AVAILABLE'. In no case shall Maghi Digital be liable for any injury, loss, or claim arising from your use of the service.

SECTION 24 – INDEMNIFICATION

You agree to indemnify and hold harmless Maghi Digital from any claims arising from your use of the Service or your Content.

SECTION 25 – SEVERABILITY

If any provision is determined to be unlawful, it shall nonetheless be enforceable to the fullest extent permitted by law.

SECTION 26 – TERMINATION

This agreement is effective until terminated by either you or us. Obligations incurred prior to termination shall survive.

SECTION 27 – ENTIRE AGREEMENT

These Terms of Service constitute the entire agreement between you and us, superseding any prior agreements.

SECTION 28 – GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts located in Giridih, Jharkhand, India.
